Tato diplomová práce se zabývá problematikou osvědčování a dokazování úpadku dlužníka v insolvenčním řízení a jejich komparací s německou právní úpravou. Práce poskytuje analýzu relevantní české a německé právní úpravy, judikatury soudů i odborné literatury.
