Legal Regulation of the Renumeration Priciples of the Private Sector Employes

Abstract:

Bakalářská práce se zabývá otázkou právní úpravy principů odměňování zaměstnanců v podnikatelské sféře. Jsou zde charakterizovány základní principy uplatňované při odměňování zaměstnanců v podnikatelské sféře, jejich současná právní úprava a její historický vývoj. Celá práce je rozdělena do pěti částí. V první části je popsán stručný historický vývoj právní úpravy v oblasti odměňování zaměstnanců. Druhá část práce je zaměřena na charakteristiku závislé práce a mzdy, která v podnikatelské sféře představuje formu odměny za vykonanou práci. Třetí část je věnována popisu základních principů uplatňovaných při odměńování zaměstnanců v podnikatelské sféře. Je zde blíže specifikován smluvní princip, princip spravedlivé odměny za vykonanou práci, princip zákazu diskriminace při odměňování, princip ochrany mzdy a jejich další dílčí principy. Čtvrtá část se zabývá problematikou odměňování zaměstnanců v kontextu práva Evropské unie a otázkou uplatňování minimální mzdy v členských státech. Poslední část se zabývá úlohou mzdového systému při aplikaci základních principů do praxe.

Abstract:

This bachelor´s thesis looks into the question of the legislation of employee remuneration principles in the business sphere. It characterises the basic principles applied in employee remuneration in the business sphere, their current legislation and its historical development. The entire thesis is divided into five parts. In the first part a brief description of the historical development of the legislation in the area of employee remuneration is given. The second part of the thesis focuses on the characteristics of dependent work and wages, which represent a form of remuneration for executed work in the business sphere. The third part is devoted to a description of the basic priciples applied in employee remuneration in the busines sphere. The contractual principle, the principle of just remuneration for executed work, the principle of no discrimination in remuneration, the principle od wage protection, and other principles are described in more detail. The fourth part focuses on the issue of employee remuneration within European Union legislation and the issue of applying a minimum wage in its Member States. The last part investigates the role of the wage system when applying the basic principles in practise.
