Local and regional referendum

Abstract:

Téma této diplomové práce je místní a krajské referendum. Účelem této práce je přiblížit místní a krajské referendum jakožto právní nástroje, které umožňují ovlivnění určitého stavu věci od té nejnižší úrovně, tedy od lidu. První část práce přiblíží zejména základní právní principy a fungování místního a krajského referenda. V této teoretické části také přiblíží možnosti soudní ochrany. Jako názorný příklad místního referenda se práce bude zabývat místním referendem v Plzni, které proběhlo v 2013. Z obecného pohledu můžeme konstatovat, že se jedná o velmi významné referendum, protože ovlivnilo fungování a podobu města na několik let od uskutečnění referenda. Současně můžeme hovořit o určitém prototypu referenda, protože okolo tohoto místního referenda bylo několik soudních sporů, a to na různých instancích našeho soudního systému. Práce se také podívá na speciální případy místních referend, které sice neproběhly, ale mají svůj specifický charakter, protože proti jejím neuskutečněním není možnost soudně se bránit a to ani přes efektivní a rychlou soudní ochranu, která v České republice je nastavena.

Abstract:

The topic of this diploma thesis is a local and regional referendum. The purpose of this work is to approach the local and regional referendum as legal instruments that allow to influence a certain state of affairs from the lowest level, ie from the people. The first part of the thesis introduces the basic legal principles and functioning of local and regional referendums. In this theoretical part he will also introduce the possibilities of judicial protection. As an illustrative example of a local referendum, the work will deal with the local referendum in Pilsen, which took place in 2013. In general, we can say that this is a very important referendum, because it affected the functioning and appearance of the city for several years. At the same time, we can talk about a prototype of the referendum, because there have been several lawsuits around this local referendum, at different instances of our judicial system. The work will also look at special cases of local referendums, which did not take place, but have their own specific character, because it is not possible to defend against judicial proceedings, despite the effective and rapid judicial protection that is set in the Czech Republic.
