Trading Company and its Name

Abstract:

Cílem bakalářské práce je popsat název a obchodní firmu podle původní právní úpravy a podle nové právní úpravy platné od 1.1.2014, porovnat jejich změny a vyhodnotit prospěch z nové právní úpravy. První část práce je věnována definici základních pojmů, které souvisí se zadaným tématem a budou se v práci vícekrát vyskytovat. Dále je popsán jednotliví vývoj právní úpravy obchodní firmy z historického hlediska až do konce roku 2013. Ve třetí kapitole je popsána tvorba obchodního firmy, principy a zásady při tvorbě obchodní firmy a stručně definováno doménové jméno. Ochrana obchodní firmy je vymezena ve čtvrté kapitole a porovnává ochranu podle původních úprav s dnešní úpravou ochrany obchodní firmy, i s pohledu nekalé soutěže, doplněné judikaturou. V závěrečných kapitolách je popsán současný stav právní úpravy obchodní firmy a porovnání změn původní úpravy s novou právní úpravou.

Abstract:

The aim of the thesis is to describe the name and the trade company under the original legislation and the new legislation in force since January 1, 2014, to compare their changes and evaluate the benefits of the new legislation. The first part deals with the definition of basic concepts related to the assigned topic that will repeatedly occur within the work. There is also described individual development of the legislation of a trade company, principles and rules for establishment of a trade company and there is a domain name briefly defined. Protection of a trade company is defined in the fourth chapter and it compares protection according to the original legislation with today's legislation of protection of a trading company as well as with the view on the unfair competition, completed by practice of the courts. In the final chapters there is described the current state of legislation of a trade company and comparison of changes of the original legislation with the new legislation.
