Abstract:

Bakalářská práce Ochranné známky v národní a mezinárodní úpravě se zabývá úpravou ochranných známek v právním řádu České republiky a EU; stručně se také věnuje mezinárodní úpravě ochranných známek. V úvodu práce rozebírá autor zákon č. 441/2003 Sb., o ochranných známkách. Samotná kapitola se věnuje i mezinárodním úmluvám o ochranných známkách. V další kapitole autor rozebírá vznik, vývoj, pojem, funkce, účel, třídění, platnost a obnovu ochranných známek. V rámci kapitoly týkající se řízení o ochranných známkách je popsána právní úprava řízení o přihlášce, průzkumu, připomínky a námitky. V souvislosti s rekodifikací soukromého práva autor při psaní bakalářské práce zohlednil změny přijaté na základě zákona č. 89/2012 Sb., občanský zákoník a do práce zahrnul kapitolu Ochranná známka jako předmět vlastnictví, kde porovnává předchozí a novou úpravu ochranné známky jako věci. V závěru bakalářské práce se autor krátce věnuje i aktuálnímu vývoji v oblasti ochranných známek. Autor konstatuje, že právní úprava ochranných známek v ČR se v důsledku nařízení EU sbližuje s úpravou v ostatních členských státech EU. Na mezinárodní úrovni je také snaha o co největší spolupráci v oblasti práv z duševního vlastnictví. Na závěr bakalářské práce se autor zamýšlí nad budoucím vývojem úpravy ochranných známek.

Abstract:

The bachelor thesis Trade Marks in National and International Legislation deals with the regulation of trade marks in the legal order of the Czech Republic and the EU; it also deals briefly with the international regulation of trade marks. In the introduction the author discusses the Act No. 441/2003 Coll., on Trade marks. The single chapter deals with international treaties on trade marks. In the next chapter the author analyses the origin, the development, the concept, the function, the purpose, the classification, the validity and the renewal of trade marks. In the chapter on the proceedings on trade mark is described the procedure for the registration, the survey, comments and objections. In connection with the recodification of the civil law the author takes into account in his thesis changes adopted under the Law No. 89/ 2012 Coll., The Civil Code and he included in his work the chapter Trade mark as the Object of the Property, in which he compares the previous and the new regulation of a trade mark as thing. In the conclusion of the Bachelor thesis the author also briefly deals with the current development in the field of trade marks. The author concludes that the legislation on trade marks in the Czech Republic as a result of the EU regulation harmonizes with the legislation in other EU Member States. At the international level, there is also an effort to maximize the cooperation in the field of the intellectual property rights. At the end of the bachelor thesis, the author reflects on the future development of the trade mark system.
