Purpose of Punishment

Abstract:

Téma této diplomové práce jsem si zvolil jak z důvodu zájmu o oblast trestního práva, tak s ohledem na mé zaměstnání, ve kterém se s udílením trestů za přestupky a výsledky trestních řízení setkávám takřka denně. V práci se zaměřím především na teoreticko-právní problematiku, kdy v první kapitole přiblížím vše související s pojmem „Trest“, tzn. co si vůbec představit pod pojmem trest, jeho srovnání s pojmem sankce, základní vydefinování pojmu a konečně jeho morální zhodnocení. Následně se ve druhé kapitole podíváme na jádro celé práce, a to samotný účel trestu. Přiblížíme si historický vývoj teorií, vypíchneme si některé problémové faktory, které se s nimi vážou a následně se seznámíme s nejdůležitějšími teoriemi vysvětlující účel trestu se zaměřením nejen na retributivismus a konsekvencionalismus, ale i na jejich vzájemné prolínání ve smíšených teoriích. Ve třetí kapitole si zmíníme okolnosti, které jsou nedílnou součástí při rozhodovacím procesu o druhu a formě ukládaného trestu, jako je povaha činu vedoucího k trestu, pozadí pachatele či efektivita trestu. V závěru pak shrnu zjištěné poznatky, přinesu vlastní pohled na věc, včetně kritického zhodnocení účelnosti trestu v českém právu a vyjádřím se k té teorii, která nejvíce odpovídá mému osobnímu pohledu na danou problematiku.

Abstract:

I chose the topic of this diploma thesis both because of my interest in the field of criminal law and with regard to my job, in which I encounter the awarding of punishments for offenses and the results of criminal proceedings almost every day. In my work, I will focus primarily on theoretical legal issues, where in the first chapter I will explain the knowledge related to the concept of „Punishment“, i. e. what to imagine under the term and finally its moral evaluation. Subsequently, in the second chapter, we will look at the core of the entire work, namely the very purpose of punishment. We will take a closer look at historical development of the theory, point out some problematic factors associated with it, and then get acquainted with the most important theories explaining the purpose of punishment, with a focus not only on retributivism and consequentialism, but also on their mutual interweaving in mixed theories. In the third chapter, we will mention the circumstances that are an integral part of the decision-making process on the type and form of the imposed punishment, such as the nature of the act leading to punishment, the background of the perpetrator or the effectiveness of punishment. In the conclusion, I will summarize the findings, bring my own perspective on the matter, including a critical evaluation of the effectiveness of punishment in Czech law, and comment on the theory that best corresponds to my personal view of the issue.
