Abstract:

Tato diplomová práce se bude zabývat problematikou překážek v práci na straně zaměstnance. Cílem diplomové práce bude podrobná analýza platné právní úpravy překážek v práci v České republice. Práce bude rozdělena na část teoretickou, která bude členěna do kapitol a část praktickou. Úvodní kapitoly se budou zaměřovat na charakteristiku pracovněprávních vztahů. Další kapitola se bude okrajově věnovat překážkám v práci na straně zaměstnavatele a následující kapitoly konkrétně překážkám v práci na straně zaměstnance, a to z hlediska hodnocení úrovně a uplatňování v praxi. V závěrečné kapitole práce se budu věnovat komparaci právní úpravy v České a Slovenské republice dle platné judikatury a dostupné literatury. Předmětem praktické části této diplomové práce bude statistické zhodnocení týkající se překážek v práci na straně zaměstnance ve vybrané společnosti.

Abstract:

The presented diploma thesis deals with impediments attributable to the employee. The focus of the thesis is a thorough analysis of Czech legal provisions regulating impediments of performance currently in effect. The thesis is subdivided into a theoretical part consisting of chapters and a research part. Opening chapters provide an overview of the labour relationship characteristics. Next chapter touches upon the impediments of performance attributable to the employer. The subsequent chapters delve into the impediments attributable to the employee taking into account practical aspects of the provisions. The final chapter compares legal regulations in the Czech Republic and the Slovak Republic based on court rulings and available study materials. The focal point of the research part is a statistical analysis of impediments of performance attributable to the employee at a chosen legal entity.
