Applicability of evidence in criminal proceedings

Abstract:

Tato práce se převážně zaměřuje na použitelnost důkazů v trestním řízení před soudem. Z hlediska použitelnosti důkazů jsou podrobněji rozebrány 3 důkazní prostředky, a to výslech obžalovaného v hlavním líčení, výslech svědka v hlavním líčení a výslech znalce v hlavním líčení. Další část práce poukazuje rovněž na jednotlivé soudní případy z justiční praxe České republiky, kdy je soudy řešena otázka použitelnosti či nepoužitelnosti daných důkazů. V neposlední řadě se čtenář stručně dozví o základních rozdílech trestního řízení ve Spojených státech amerických, a to oproti trestnímu řízení standardně vedeného v České republice. Tato práce se rovněž poměrně podrobně věnuje obecně dokazování a jednotlivým zásadám trestního řízení. Čtenář by si měl po přečtení této práce udělat poměrně ucelenou představu o problematice dokazování a měl by si odnést i základní výkladové principy z hlediska použitelnosti či nepoužitelnosti jednotlivých důkazů.

Abstract:

This work mainly focuses on the applicability of evidence in criminal proceedings. From the point of view of the applicability of the evidence, 3 means of evidence are analyzed in more detail, namely the interrogation of the defendant in the main trial, the interrogation of a witness in the main trial and the interrogation of an expert in the main trial. The next part of the work also points to individual court cases from the judicial practice of the Czech Republic, where the courts address the issue of applicability or inapplicability of the evidence. Last but not least, the reader will learn briefly about the basic differences in criminal proceedings in the United States of America, compared to the criminal proceedings normally conducted in the Czech Republic. This work also deals in some detail with the general evidence and the various principles of criminal proceedings. After reading this work, the reader should get a relatively comprehensive idea of the issue of evidence and should take away the basic principles of interpretation in terms of applicability or inapplicability of individual evidence.
