Discontinuance of Distraint for Lack of Assets

Abstract:

Diplomová práce se zabývá zastavením exekuce z důvodu nemajetnosti na straně povinného. Práce je zaměřena na právní úpravu zastavení bezvýsledných exekucí po účinnosti zákona č. 286/2021 Sb. Analyzuje některé problémy, které přinesla právní úprava zastavení bagatelních exekucí v praxi. Současně přibližuje právní úpravu zastavení dlouho-době bezvýsledných exekucí na Slovensku a srovnává ji s českou práv-ní úpravou. Na základě rozboru jednotlivě zjištěných nedostatků sou-časné právní úpravy jsou předloženy návrhy de lege ferenda.

Abstract:

The thesis deals with discontinuance of distraint in situation, where no assets is found on the part of debtor. It is focused on the legal regula-tion of the enforcement code after the act 286/2021 entered into force. It analyses some of the problems brought about by the legisla-tion of discontinuance of trifling execution in practice. At the same time, it provides an overview of the legislation of discontinuance of long-term unsuccessful execution in Slovakia and compares it with the Czech legislation. Based on the analysis of the individually identified shortcomings of the current legislation, de lege ferenda proposals are presented.
