The labour legislative dispute about invalid notice from the employer's point of view

Abstract:

Diplomová práce se zabývá problematikou pracovněprávních vztahů. Hlavním tématem je spor o určení neplatnosti výpovědi ze strany zaměstnavatele a všechny souvislosti, které soudnímu sporu předcházejí. V teoretické části se nejdříve zabývám definicí pracovněprávního vztahu a účastníků těchto vztahů. Dále se zabývám všemi způsoby skončení pracovního poměru, jejich věcnými a časovými podmínkami definovaných legislativou. Tyto způsoby skončení pracovního poměru vysvětluji pomocí legislativy a příslušných paragrafů zákoníku práce, včetně jejich provázanosti. Toto je velmi důležitá část, bez které se zaměstnavatel při ukončování pracovního poměru neobejde a měl by ji znát. V další části píši o důsledcích neplatné výpovědi ze strany zaměstnavatele. Dále popisuji, jak může vypadat soudní spor, co nás všechno čeká u soudu a jaké následky z prohraného soudního sporu mohou potkat zaměstnavatele. V praktické části se snažím vytvořit přesný návod u vybraných typů výpovědí, tak aby zaměstnavatel nepochybil a v případě soudního sporu mohl prokázat, že všechny podmínky dané legislativou splnil a tím bude mít větší šanci na úspěch. Dále rozebírám konkrétní soudní případy ve vybrané firmě a ukazuji, kde zaměstnavatel pochybil, a proto soudní spor prohrál. Na základě této analýzy se snažím vytipovat a ukázat nejčastější chyby v praxi zaměstnavatelů při realizaci vybraných výpovědních důvodů. Cílem této diplomové práce je tedy vytvořit přesné návody pro zaměstnavatele u vybraných typů skončení pracovního poměru tak, aby se pokud možno předešlo soudním sporům a s tím spojenými náklady a nepříjemnostmi.

Abstract:

This thesis deals with the problems with employment relations. The main theme is a dispute about the invalidity of the notice from the side of the employer and the relationships that precede litigation. In the theoretical part we will first deal with the definition of the employment relationship and the participants in these relationships. I then further deal with all forms of termination of employment, the substantive and temporal conditions defined by law. These ways of terminating the working relationship are explained with help from the legislation and the relevant articles of the Labour Code, including their interrelations. This is a very important part that the employer should know before termination of employment. In the next part I write about the consequences of unfair dismissal by the employer. Also there will be described how a potential lawsuit could look, what we all expect in court and what the consequences of a lost lawsuit can mean to an employer. In the practical part I try to create exact instructions for selected types of terminations, so that the employer doesn’t err, and in the event of litigation to prove that all the conditions of the legislation has been met and thus will have a greater chance of winning. Further I will analyze specific legal cases in selected companies and show where the employer was wrong, and therefore lost the lawsuit. Based on this analysis, I try to identify and show the most common mistakes made by employers in its implementation and selected reasons for dismissal. The aim of this thesis is to develop accurate guidlines for employers in selected types of termination of employment, so that, if possible, avoid litigation and the associated costs and inconvenience.
