The Comparison of legal regulation operative search measures, activities in the Czech republic and the Germany

Abstract:

Tato diplomová práce se zabývá prostředky operativně pátrací činnosti používanými zejména orgány činnými v trestním řízení v České republice a Spolkové republice Německo při vyšetřování organizované trestné činnosti, jejich vzájemným porovnáním, zejména nalezení odlišností při použití operativně pátracích prostředků s cílem definovat efektivnější postup při vyšetřování trestné činnosti. Teoretická část se zabývá stručným popisem právní úpravy operativní činnosti s využitím operativně pátracích prostředků, či podpůrných operativně pátracích prostředku v České republice a Spolkové republice Německo. V praktické části je provedena komparace právní úpravy operativně pátracích prostředků ve spojitosti s podpůrnými operativně pátracími prostředky v obou zemích, se zaměřením na odlišnosti těchto úprav včetně procesních aspektů. Práce je zaměřena jednak na zkoumání těchto prostředků v obou zemích, jak z hlediska operativního, při kterém jsou získávány informace operativní povahy, bez dalšího procesního použití, tak z hlediska procesního. Tyto prostředky jsou zkoumány a porovnány i z hlediska procesního postavení v právním řádu, včetně jejich procesu povolování se zaměřením jejich aktuální flexibilitu v dynamicky vyvíjející se oblasti organizované trestné činnosti. Cílem závěrečné práce je porovnání právní úpravy a možnosti využití operativně pátracích prostředků při vyšetřování zejména organizované trestné činnosti v České republice a Spolkové republice Německo. Vzájemné porovnání využití těchto prostředků v policejní činnosti porovnávaných zemí a jejich využitelnost v trestním řízení.

Abstract:

This thesis deals with the means of operational search used mainly by law enforcement agencies in the Czech Republic and the Federal Republic of Germany in the investigation of organized crime, their mutual comparison, in particular finding differences in the use of operational search means in order to define a more effective procedure in the investigation of crime. The theoretical part deals with a brief description of the legal regulation of operational activities with the use of operational search means or supporting operational search means in the Czech Republic and the Federal Republic of Germany. In the practical part, a comparison of the legal regulation of operational search means in connection with operational search means in both countries is made, focusing on the differences of these regulations, including procedural aspects. The thesis focuses on the examination of these means in both countries, both from the operational point of view, in which information of an operational nature is obtained without further procedural use, and from the procedural point of view. These means are also examined and compared in terms of their procedural status in the legal system, including their authorisation process, with a focus on their current flexibility in the dynamically evolving field of organised crime. The aim of the final thesis is to compare the legal regulation and the possibility of using operational search means in the investigation of organised crime in the Czech Republic and the Federal Republic of Germany. A mutual comparison of the use of these means in the police activities of the compared countries and their applicability in criminal proceedings.
