Crimes against life and health

Abstract:

The aim of the bachelor’s work is to point out the theoretical aspects of the thesis, enumerating and clarifying the particular criminal offences which are in the criminal act divided according to the protected priority into criminal offences against life, health and criminal offences impending life and health. The thesis focuses on individual bodies of the criminal offences, clarification who is the offender, if the culpable intent is required or neglect is sufficient. Further on it gives examples of individual criminal offences. Within the frame of this work the recent legal enactment with the former legal act no. 140/1961 of the Coll. Recent effective legal norm enacting criminal offences against life and health is the legal act no. 300/2005 is compared. The criminal offences are listed in the first chapter of the law’s special part. This act also defines particular terms concerning not only the criminal offences against life and health, as the protected person, bodily harm, property advantage and so on. With these criminal offences evidence is crucial, yet also proving the intent or criminal offence preparation. Last but not least the work also the punishment of the offender. In this work the importance of some terms which are closely linked to other legal branches and legal acts are emphasized such as for example Legal act on foodstuff no. 152/1995 of the Coll., Legal act on narcotics no. 139/1998 of the Coll. or Legal act on medicaments and sanity material.

KLINCOVÁ, Kristína: Trestné činy proti životu a zdraviu, Bankoví inštitút vysoká škola Praha, Katedra ekonómie a spoločenských vied, Právna administratíva v podnikateľskej sfére, JUDr. Jaroslav Klátik, PhD., Banská Bystrica, 2010, 45 strán, bakalárska práca. Cieľom bakalárskej práce je poukázanie na teoretické aspekty témy, vymenovanie a objasnenie jednotlivých trestných činov, ktoré sú v právnej norme rozdelené podľa chráneného záujmu na trestné činy proti životu, trestné činy proti zdraviu a trestné činy ohrozujúce život a zdravie. Sústreďujem sa najmä na jednotlivé skutkové podstaty týchto trestných činov. Objasnenie toho, kto je páchateľom, či je potrebné úmyselné zavinenie, alebo stačí nedbanlivostné. A taktiež pripájam príklady k jednotlivým trestným činom. V práci v rámci komparácie starého zákona s novým Trestným zákonom spomínam staršiu právnu normu, ktorá predchádzala dnešnej úprave, a to je zákon č.140/1961 Zb. Dnešnou platnou právnou normou upravujúcou trestné činy proti životu a zdraviu je Trestný zákon č. 300/2005, konkrétne sú uvedené v prvej hlave osobitnej časti tohto zákona. V tomto zákone, sú zadefinované aj jednotlivé pojmy týkajúce sa nielen trestných činov proti životu a zdraviu, pojmy sú chránená osoba, ublíženie na zdraví, majetkový prospech a podobne. Kľúčové, pri týchto trestných činoch je aj dokazovanie, či už dokazovanie úmyslu alebo prípravy trestného činu. A v neposlednom rade je to aj potrestanie páchateľa. V práci by som chcela zdôrazniť dôležitosť niektorých pojmov, ktoré úzko súvisia aj s inými odvetviami a inými právnymi predpismi ako napríklad Zákon o potravinách č. 152/1995 Z.z., Zákon o omamných látkach č. 139/1998 Z.z., zákon č. 140/1998 o liekoch a zdravotníckych pomôckach.
