The Analysis of the Collective Agreement

Abstract:

Téma mé bakalářské práce je „Analýza kolektivní smlouvy zaměstnavatele.“ Cílem mé práce bylo popsat základní charakteristiku kolektivní smluvy jako pramene práva a provést analýzu kolektivní smlouvy zaměstnavatele. Má práce se skládá z osmi kapitol, ale obecně je rozdělená na dvě části. V první části jsem se snažil charakterizovat náležitosti kolektivní smlouvy stanovené zákoníkem práce a zákonem o kolektivním vyjednávání. Ve druhé části své práce jsem se snažil analyzovat kolektivní smlouvu zaměstnavatele a nálézt články a ustanovení, která nejsou v souladu se zákonem a které by měli být v příští kolektivní smlouvě změněny. V závěru své práce jsem se snažil dát doporučení na možné změny, které by měmly být provedeny v příští kolektivní smlouvě.

Abstract:

The topic of my dissertation is “The Analysis of the Collective Agreement of the Employer”. The aim of this dissertation is to describe the general characteristics of the collective agreement as a source of law and to provide an analysis of the collective agreement of the employer. The paper consists of eight chapters in particular, but it is divided into two parts in general. The former contains an attempt at characterizing the appropriate elements of the collective agreement provided for by legislation, namely by the Labour Code and the Collective Bargaining Act. The latter attempts at analysing a particular collective agreement of the employer, and at finding clauses and provisions which are not in accord with legislation and which should be altered in the future texts of the collective agreement.
