Analysis of Contemporary Rules Concerning the Status of Animals in the Legal System

Abstract:

Autor se pokouší o filosofickou analýzu reflektující současnou situaci postavení zvířat ve společnosti s přesahem do oblasti práva a ekonomie. S aktuální občanskou percepcí situace zvířat se mnohé evropské země vypořádávají vlastními způsoby právních reforem. Česká republika je v tomto ohledu v rozporuplné situaci. Přestože už došlo k prvním reformám, momentální situace je protichůdná. Pokusy o reformace právní recepce zvířat byly započaty, avšak doposud nevyčerpávají problematiku, kterou daná oblast vyvolává s ohledem na respektování individuálních zájmů zvířat. Doposud není pozice zvířat jasně rozlišena ústavním právem, na úrovni soukromého práva se nejedná o jasně formulovanou úpravu. Cílem práce je pokus o artikulaci společensko-ekonomické reformy, která si klade za cíl pojmout specifickou situaci hospodářských zvířat. K tomuto účelu byly stanoveny tři kritéria stanovující možnost na nezávislé žití a na zvyšující se poptávku po úrovni welfare chovaných zvířat. Rozeznání individuálních zájmů zvířat se z pohledu vědy váže na teorie vědomí, které dokáží korigovat rozporuplné pozice: historické a současné. Revizí současné situace s ohledem na výše zmíněná kritéria bylo možné najít koherentní řešení s perspektivním přesahem do zvýšení celkové kvality životních podmínek hospodářských zvířat.

Abstract:

Author of this paper attempts a philosophical analysis reflecting on contemporary situation of the position of animals in the society with an overlap with the area of law and economics. The current civic perception of the animal situation is being solved by many European countries in their own ways of legal reform. The Czech Republic is in a conflicting situation in this respect. Despite the first reforms, the current situation is contradictory. Attempts to reform the legal reception of animals have begun, but have not yet exhausted the issues that the area raises with respect to individual interests of animals. So far, the position of animals is not clearly distinguished by constitutional law, at the level of private law it is not a clearly formulated rule. The aim of this thesis is an attempt to articulate socio-economic change, which aims to adjust the specific situation of farm animals. For this reason, three criteria have been established, setting out the possibility of independent living and increasing demand for the level of welfare of farm animals. The recognition of the individual interests of animals is from the perspective of science linked to theories of consciousness that can correct the contradictory positions: historical and contemporary. By revision of the current situation with consideration to the above mentioned criteria it was possible to find a coherent solution with a perspective overlap into increase of overall quality of animal welfare.
