Administrative Punishment in the Practice of the Trade Licence Offices

Abstract:

Tato práce se zabývá právem správního trestání obecně a s následným přihlédnutím k praxi živnostenských úřadů. Cílem práce je provést rozbor a zhodnocení platné právní úpravy správního trestání aplikované živnostenskými úřady a zamyslet se nad jejím předpokládaným dalším vývojem v postavení správního práva. Čtenář se v úvodu práce zorientuje v oblasti správního trestání, v zásadách, znacích a klasifikaci správních deliktů včetně sankcí. Těžiště práce rozvádí problematiku správního trestání živnostenských úřadů dle zákona o živnostenském podnikání, úpravu přestupků a správních deliktů podnikatelů, zvláštní důraz je kladen na trestání v souvislosti s neoprávněným podnikáním. Pro doplnění daného tématu je dále rozebrána praxe živnostenských úřadů ve specifických oblastech správního trestání jako např. v oblasti ochrany spotřebitele. Úvaha nad popsanou problematikou stávající a budoucí představuje potom vyústění celé práce.

Abstract:

This bachelor´s thesis deals with law of administrative punishment in general and with successive practise of the Trade Licence Offices. The aim of the thesis is analysing and evaluating currently valid legal modifications of administrative punishment applied by the Trade Licence Offices and contemplating about its anticipated progress link-up an administrative law. In the introduction the reader of this thesis will orientate oneself in the field of administrative punishment, principles, characters and classification of administrative delicts including the sanctions. The fundamental content of the thesis forms the matters of administrative punishment implemented by the Trade Licence Offices according to the law about the trade licence business, adjustment of the offences and the administrative delicts of entrepreneurs, with special emphasis on unauthorized business punishments. For completion of the topic there is an analyse of the practise of the Trade Licence Offices in specific areas of the administrative punishment, for example in the area of the protection of the consumers. The consideration about the described current and future matters presents then the summary of the thesis.
