Abstract:

Práce se zabývá pojmem poškozeného a jeho postavením v jednotlivých fázích trestního řízení. Dále jakým způsobem se může poškozený domáhat náhrady škody v adhezním řízení. Je pojednáno o jednotlivých právech poškozeného a co sebou přinášejí. poškozený je rozebrán i po stránce jakým způsobem působí na celé trestní řízení a jeho nezastupitelná role v poskytování usvědčujících důkazu proti obviněnému. Práce se zprvu zaměří na pojem poškozeného z jeho historického hlediska a přesouvá se až po současnost, kde jsou uvedeny podstatné změny související s poškozeným. Především je důležitá změna poškozeného v jeho pojmu a dále zákon o obětech, který bude účinný v 1.8.2013 a přinese řadu změn, které jsou již v práci zakomponovány. Neméně podstatnou složkou je i kapitola o mediaci, která osvětluje rozdíly mezi probační a mediační službou a nově účinným zákonem o mediaci. Uvedeny jsou jednotlivé postupy mediátorů a nejsou zapomenuty ani určitá negativa, která se skrývají pod mediační činnosti. zastoupeny jsou v práci jako instituty zastupování poškozeného a jeho jednotlivé formy zastupovaní, dohoda o vině a trestu.

Abstract:

The theses deals with the concept of the victim and his position in the various stages of the criminal proceedings. Furthermore, how the victim may claim damages in the adhesion process. It discusses the rights of the victim and what they bring. Damage is discussed also in terms of how it affects the entire criminal procedure and its irreplaceable role in providing incriminating evidence against the accused person. The theses initially focused on the concept of victim of its historical perspective and moves to the present, where there are substantial changes related to the victim. First, it is important to change the victim in his concept of law and the sacrifices that will be effective on August 1, 2013 and will introduce a number of changes that are already incorporated in the theses. Equally essential component is a chapter on mediation, which explains the differences between the Probation and Mediation Service and the newly effective law on mediation. The following are the various procedures and mediators are not forgotten or some negatives that are hiding under the mediation activities. In the theses are represented such of institutions representing the victim and his various forms of representation, agreement on guilt and punishment.
