Abstract:

Diplomová práce je založena na analýze pojmenovávacích, syntaktických a textotvorných prostředků platného zákona č. 513/1991 Sb., tj. Obchodního zákoníku. Pro práci s textem byl vytvořen automaticky označkovaný korpus Zákoník v korpusovém rozhraní BONITO 2, což umožnilo aplikovat kvantitativní přístup k lexikálnímu a syntaktickému rozboru celého zákoníku. Pro detailnější analýzu syntaktických a textotvorných prostředků byl ze zákoníku vybrán jeden úsek textu (Část III, Hlava III). Analýza Obchodního zákoníku ukázala, že i když tento text patří k právnímu jazyku, je zároveň blízký i administrativnímu a odbornému jazyku. Následující jazykové rysy jsou společné pro jazyk Obchodního zákoníku, právní jazyk, administrativní jazyk a odborný jazyk: vysoký index opakování slov, užívání termínů, slovních spojení a šablon, abstraktní vyjadřování, syntaktická explicitnost, nominalizace, pasivní konstrukce, sekundární předložky, spojovací výrazy, propracované horizontální a vertikální členění textu, tematické linie, grafické symboly pro větší přehlednost. Přitom nadměrné užití genitivu adnominálního je charakteristické pouze pro administrativní jazyk a právní jazyk, tedy i Obchodní zákoník. Právní texty a analyzovaný zákon sbližují následující jazykové rysy: věty s výčtovou strukturou, modální slovesa a výrazy, užití slovesa být v definicích, užití instrumentálu v definicích, oznamovací způsob dokonavých sloves a budoucí čas trpného rodu dokonavých sloves ve funkci imperativu, paralelní větné struktury, absence kohezních prostředků mezi větami, víceúrovňové horizontální členění textu. Nicméně Obchodní zákoník má svoje specifika hlavně zvýšený počet maskulin životných a nadprůměrný počet cizích slov. Zvýšený počet maskulin životných podmiňuje i zvýšený výskyt dativu a zvýšený výskyt zájmen. Nadprůměrný počet cizích slov má za následek podprůměrný počet adjektiv.

Abstract:

The dissertation is based on lexical, syntactic and textual analysis of Commercial Code 40/1964 Coll. An automatically tagged corpus designed for this purpose is available in the corpus manager BONITO 2. The tagged corpus made it possible to apply the statistical method for the lexical and syntactic analysis of the whole law. A more detailed syntactic analysis in combination with the textual analysis is carried out on one section of the law (Chapter III of Part III). The results can be summed up as follows: the Commercial Code belongs to the category of legal texts and it also shares common features with administrative texts and scientific texts. At the same time the analysed law has its own distinctive features. The following characteristics are shared between the Commercial Code and legal, administrative and scientific texts: high index of word re-occurence, use of terms, use of set phrases and expressions, abstract nouns, explicit syntactic constructions, nominalization constructions, passive constructions, multi-word prepositions and conjunctions, thematic lines, elaborate text composition and use of graphic symbols for visual aid. Excessive use of Genitive constructions is typical of both administrative and legal texts and it is therefore also evident in Commercial Code. The analysed law is stylistically closest to legal register. The subsequent features are characteristic of legal texts in general, including the Commercial Code: sentences with enumerative structure, modal verbs and expressions, use of the verb to be in definitions, use of Instrumental case in definitions, use of perfective verbs in indicative mood in the function of imperative, parallel sentence structures, absence of cohesive devices between sentences, multi-level horizontal segmentation. The Commercial Code differs in some features from other legislative texts. The number of male animate nouns in the Commercial Code is above average, which explains a higher occurrence of the Dative case and pronouns. A high number of loan words in the analysed law causes the decrease in adjective usage since loanwords frequently have precise meaning and do not require any specification by adjectives.
