Abstract:

Tato diplomová práce se věnuje popisu a analýze institutu nájmu bytu z hlediska platné právní úpravy NOZ, která je v závěru práce komparována se španělskou úpravou nájmu bytu. V první kapitole je představena historie právní úpravy nájmu bytu, a to již od doby římského práva až po právní úpravu OZ, který byl v roce 2014 nahrazen NOZ. V dalších kapitolách jsou představeny základní pojmy související s problematikou nájmu bytu. Vyhodnocena je platná právní úprava tohoto institutu z jednotlivých aspektů, představeny jsou též nové instituty, které NOZ zavedl. Pozornost je také věnována nájemnímu vztahu, vzniku nájmu bytu a jeho zániku. Popsána jsou jednotlivá práva a povinnosti nájemních stran. Závěr práce je tvořen krátkou komparací španělské a české právní úpravy nájmu bytu a na to navazujícími úvahy de lege ferenda.

Abstract:

This diploma thesis deals with the description and analysis of the institute of renting an apartment from the point of view of the valid legal regulation of NOZ, which is compared with the Spanish regulation of renting an apartment. The first chapter presents the history of the legal regulation of renting an apartment, from the time of Roman law to the legal regulation of trademarks, which was replaced in 2014 by NOZ. The next chapters introduce the basic concepts related to the issue of renting an apartment. The valid legal regulation of this institute is evaluated from individual aspects, new institutes introduced by NOZ are also introduced. Attention is also paid to the tenancy, the origin of the lease of the apartment and its termination. The individual rights and obligations of the tenants are described. The conclusion of the thesis consists of a brief comparison of the Spanish and Czech legislation on renting an apartment and the related considerations de lege ferenda.
