The right to a fair procedure within the exercise of public administration in the field of security

Abstract:

Diplomová práce se zaměřuje na problematiku uplatňování práva na spravedlivý proces v kázeňském řízení příslušníků bezpečnostních sborů podle zákona č. 361/2003 Sb., o služebním poměru. Cílem práce je analyzovat, do jaké míry jsou v praxi respektovány základní procesní garance, jako je nezávislost a nestrannost rozhodovacího orgánu, zákonnost řízení, přiměřenost jeho délky, veřejnost řízení a právo na přístup k rozhodovacímu orgánu. Práce je rozdělena na část teoretickou a praktickou. V teoretické části je pozornost věnována historickému vývoji a ústavněprávnímu zakotvení principů spravedlivého procesu, včetně jejich aplikace ve specifickém kontextu správního trestání. Praktická část je věnována analýze interních předpisů Policie České republiky a Hasičského záchranného sboru Plzeňského kraje, přičemž je zhodnoceno jejich naplňování zásad spravedlivého procesu. Výsledky analýzy poukazují na určité rozdíly v metodice a aplikační praxi, které mohou mít vliv na postavení obviněného příslušníka v řízení. V závěru jsou navržena doporučení směřující k větší harmonizaci postupů a posílení ochrany procesních práv příslušníků bezpečnostních sborů.

Abstract:

This thesis focuses on the issue of ensuring the right to a fair trial in disciplinary proceedings of members of security forces, as regulated by Act No. 361/2003 Coll., on the Service Relationship of Members of Security Forces. The aim of the thesis is to analyse to what extent fundamental procedural guarantees—such as the independence and impartiality of the decision-making authority, the legality of the proceedings, the proportionality of their duration, the public nature of the proceedings, and the right of access to a decision-making body—are respected in practice. The thesis is divided into theoretical and practical parts. The theoretical part addresses the historical development and constitutional framework of the principles of a fair trial, including their application in the specific context of administrative punishment. The practical part is dedicated to the analysis of internal regulations of the Police of the Czech Republic and the Fire Rescue Service of the Plzeň Region, assessing how these internal frameworks adhere to the principles of a fair process. The findings reveal certain differences in methodology and application, which may affect the legal position of the accused officer. In conclusion, recommendations are proposed to enhance harmonisation of procedures and to strengthen the protection of procedural rights of members of security forces.
