Law and Sport - Legitimacy of Sport Rules

Abstract:

V první kapitole jsem se pokusil o nejzákladnější nástin sportu a jeho vztahu k právu. Snažil jsem se ukázat, kam až sahá autonomie sportu, a kde je již zásah práva možný a někdy i nezbytný. U sportu jde o vítězství, kdy mezi sebou soupeři poměřují síly, ne vždy však u toho používají povolených sportovních a právem dovolených prostředků. Snažil jsem se tato porušení sportovních a právních norem roztřídit do možných variant, které mohou při sportování nastat Tato práce se zaměřuje na fotbal, jeho organizaci a mezinárodní aspekty tohoto sportovního odvětví. Sport a právo není možné chápat jen na vnitrostátní úrovni, ale jeho regulace je nutno umístit minimálně do evropského kontextu, ale nejlépe do mezinárodního. Sport a právo není vázáno na národní legislativu, ale obsahuje značný mezinárodní rozměr. V kapitole II. této práce je struktura fotbalu identifikována jako pyramida, na jejíž nejnižší úrovni jsou kluby. Nad nimi stojí národní federace (u nás ČMFS), které upravují všechny záležitosti spojené s fotbalem a jeho organizací a zastupují fotbal v evropské a světové fotbalové federaci. Veškerá pravidla organizace fotbalu musí být schválena organizací FIFA. Tato pravidla jsou závazná pro národní asociace, a tím i pro její členy, včetně fyzických osob, např. profesionálních hráčů. Pokud tedy sportovec uzavře profesionální vztah s klubem, je vázán všemi pravidly, včetně disciplinární pravomoci. Pokud je s nějakým výsledkem případ uzavřen v disciplinárním řízení, nelze se v této práci (kap. I.5.1.) nezmínit o rozhodčím řízení ve sportu a to především o Arbitrážním soudu pro sport (CAS) a jeho významu. Na CAS ve svých stanovách odkazují FIFA a UEFA, a akceptovali tím jeho jurisdikci. Ve třetí kapitole této práce jsem se zaměřil na pravidla fotbalu jako sportovní normy a rozhodnutí Evropského soudního dvora, která tato pravidla ruší, modifikují nebo ponechávají v platnosti. Začal jsem již notoricky známým rozsudkem Bosman, ale vynechat ho není možné, protože to je první a průlomový rozsudek, jež ingeneroval do pravidel vydané mezinárodními fotbalovými federacemi FIFA a UEFA. Rozsudek Bosman stejně jako rozsudek Simutenkov se týkají přestupových pravidel a představují ucelený obraz o transferech fotbalistů ve vztahu k evropskému právu. Jsou důkazem, jak právo dokáže významně ovlivnit sportovní normy a kde končí autoregulace sportovních organizací. Dále jsem uvedl rozsudek ve věci pana Piaua a dlouho očekávaný a dosud stále neukončený spor ve věci Charleroi. Snažil jsem se naznačit i možnosti budoucího směřování evropského fotbalu.

Abstract:

Sport is an activity that millions of people all around the world keep on doing. Sport is fun, relaxation and for the best – it could be a daily job. Law as well as sport is coming into lives of all people. The target of this essay is to examine the mutual coexistence of these two social standards sub-groups. This essay is mainly focused on football – its organization and international aspects of this branch of sport. It is not possible to consider sport and law only at the domestic level but it is necessary to regulate them at least at the European level or preferably at the international one. Both sport and law are not only govern by national legislature but also in compliance with international dimension. In the chapter II. of this work you can find a structure of football which is described as a pyramid. The lowest level of this pyramid is represented by the clubs. Above them there is a national federation (ČMFS in the Czech Republic). This organization is regulating all issues related to football and its organization also they are substituting football by European and world football federation. Each rule of football organization has to be approved by organization called FIFA. These rules are bounding the national associations and therefore also for their members – individuals, for example professional players. When the athlete signs the professional contract with the club, he has a duty to follow the rules stated by the disciplinary authority. If there is a case closed with the disciplinary action it is not possible to forbear mentioning the case to Court of Arbitration for sport (CAS) whereon are FIFA and EUFA adverting to in their regulations and therefore they had accepted judicature CAS. The sport standards accepted by the transnational organizations are similar to a mixture of law principles of different law cultures similarly to the present law of the European Union. The sport law lives the same situation as other legal branches in the recent past. An explicit example includes labour law that has been initially set up on contractual rights. Labour law gradually developed because of the rise of legislature for the working environment. I don´t insist that the sport law is already an individual legal branch but it might have become in future. The constant growth and widening of the individual sport branches with the growth of the legislature may cause the creation of the new law branch – Law of Sport. The problem is that the possible sport law could interfere into large range of already existing legal branches – for example to civil, labour, penal and international laws. This fact could cause huge requirements on the person who would like to get into the heart of the law branch. I attempted to show the basic of the relationship between sport and law. I also tried to show where the self-government of law extends and where already you can find the possible interference of law. The main goal of sport is the victory, where the rivals are comparing their strengths not always using standards allowed. I tried to classify these sports and law norms into various possibilities, which can occur during doing sports. My thesis also contains a special part which is focused on the football rules as sport´s rules and also on the decisions of The European Court of Justice, which cancels, modifies or comfirms validity of these sport´s rules. Bearing in mind the importance of these decisions I firstly described the Bosman´s decission as the most important decission amending the rules issued by the international football federations FIFA and UEFA. Bosman´s decision as well as Smutenkov´s decision concerning the rules of transfer and make these rules more clear. These decisions precisely show how the law can significantly influenced the rules of sport and where are the limits of the self-goverment of the sport organisations.
