Probation a mediation services with focus on community services

Abstract:

Podstatou bakalářské práce je polemika na téma činnosti Probační a mediační služby České republiky, a to proto, že je považováno působení této organizace za prospěšné pro naši společnost a mnozí z nás nemají o její existenci žádné informace. Stěžejním předmětem práce je pojednání o ukládání a výkonu jednoho z alternativních trestů -- trestu obecně prospěšných prací. V první části se dílo zaměřuje na právní ukotvení Probační a mediační služby u nás a vysvětluje související pojmy, detailněji popisuje trest obecně prospěšných prací a přínos tohoto trestu pro společnost i samotné pachatele. Je zde začleněna návaznost na finanční systém státu a ekonomické porovnání s udělením nepodmíněného trestu odnětí svobody. Dále se práce zaměřuje na srovnání trestu obecně prospěšných prací u nás a ve vybraných státech Evropy. Cílem práce je prostřednictvím analýzy, osobního sběru dat a dedukce komplexní náhled na současnou situaci působení Probační a mediační služby, udělování alternativních trestů a náhled do institucí v jiných evropských zemích a jejich srovnání.

Abstract:

The base of this bachelor's work focuses on activities of Probation and Mediation Services in the Czech republic. These activities are generally considered beneficial to the society but their existence in not commonly known to public. The core topic of this theoretical work is the polemic about infliction and carrying out of one of the alternative punishment -- the community service. The first part of the work concentrates on legal anchoring of the Probation and Mediation Services in the Czech republic and explains connected terms and lexis, it describes in detail the basis of community service, its benefit for the society and for the perpetrators themselves. This part also includes continuity on the state financial system and economic comparison with the infliction of suspended punishment. Furthermore this work focuses on comparison of the community service in our country and in other selected countries of Europe. The work aims to give united view on current situation of the effect of Probation and Mediation Service via analysis, collecting data and deduction. It offers overview of infliction of alternative kinds of punishment, look at institutions in various European countries and their comparison.
