Neighbour Relationship Problem-Solving in SR and Selected Countries of the EU in Comparison

Abstract:

The aim of this Bachelor's thesis is to compare solving problems in neighbour relations in the Slovak Republic and in chosen states of European Union. The thesis is divided into three main chapters. The first chapter consists of definitions of concepts which are related to neighbour relations. It defines the object and the subject of neighbour rights. It also discusses the rules of using property in which it defines the concept of ownership, as well as the ownership's law. In this chapter we also discuss the neighbour relations in the past. The second chapter analyses the legal arrangements of neighbour relationships according to the ownership law. This chapter covers the basic regulations of the ownership law, the ways of menace to a neighbour's property and also the ways of defence against this activity. The third chapter covers proposals to solve neighbour conflicts in the Slovak Republic and in chosen states of the European Union and their comparison among themselves.

Abstract:

Bakalárska práca sa zaoberá komparáciou riešenie problémov susedských vzťahov v SR a vo vybraných štátoch EÚ. Práca je rozdelená do troch hlavných kapitol. Prvá kapitola je zameraná na definovanie pojmov súvisiacich so susedskými vzťahmi. Definuje objekt a subjekt susedských práv. Takisto rozoberá právnu úpravu používania nehnuteľnosti, kde definuje pojem vlastníctvo a vlastnícke právo. Ďalej sú v kapitole rozobraté susedské vzťahy v minulosti. Druhá kapitola analyzuje právnu úpravu susedských vzťahov podľa konkrétneho právneho poriadku. Táto kapitola obsahuje základné ustanovenie o vlastníckom práve, spôsoby ohrozovania susedovej nehnuteľnosti ale aj spôsoby ochrany proti takémuto konaniu. Tretia kapitola prináša návrhy riešení susedských konfliktov v SR a vo vybraných štátoch v EÚ a ich porovnanie medzi sebou.
