The Election Court and its Jurisdiction

Abstract:

Tématem diplomové práce je činnost Volebního soudu a jeho judikatura. Po krátkém teoretickém úvodu je nejprve popsán vývoj volebního soudnictví v Československu v letech 1920 až 1946. Následně je nastíněna organizace Volebního soudu se zaměřením na jeho personální obsazení. Podrobně je analyzována působnost Volebního soudu, a to zejména jeho pravomoc rozhodovat o ztrátě mandátů členů československého parlamentu. Popsáno je i řízení před Volebním soudem se zaměřením na odlišnosti od řízení před Nejvyšším správním soudem, s nímž byl Volebním soud těsně spojen. Nakonec je analyzována nejvýznamnější judikatura Volebního soudu.

Abstract:

The thesis deals with activities of the Election Court and its jurisprudence. After a brief theoretical introduction, the development of electoral justice in Czechoslovakia from 1920 to 1946 is described. Subsequently, the organization of the Election Court is outlined, focusing on its personal composition. Then, the competences of the Election Court are analysed in detail, with focus on its power to decide on the disqualification of members of the Czechoslovak parliament. The proceedings before the Election Court are also described, focusing on differences from the proceedings before the Supreme Administrative Court, which was closely connected with the Election Court. Finally, the most important case law of the Election Court is analysed.
