Legal Aspects of the Disposal with the Used Software
Abstract:
Tato práce se zabývá problematikou nakládání s použitým software s ohledem na zvláštní povahu počítačového programu. Reaguje na trend evropského trhu, speciálně toho německého, kdy společnosti začínají nabízet obchodování s použitými licencemi. Hlavním cílem je stanovit legální způsoby prodeje použitého software. Za účelem naplnění tohoto cíle je uvedena relevantní judikatura německých soudů.
Abstract:
This thesis deals with issues of the disposal with used software with regard to the specific nature of computer programs. It responds to the trend of the European market, especially the German market, when companies begin to offer second-hand licenses. The main goal is to provide legal ways of selling used software. To meet this goal, it has been given the relevant case law of German courts.
