Insolvency proceedings of natural persons

Abstract:

Tato diplomová práce je zaměřena na řešení úpadku podnikajících fyzických osob prostřednictvím oddlužení v kombinované formě, tj. plněním splátkového kalendáře se zpeněžením majetkové podstaty. Na základě literární rešerše a deskripce je popsán specifický průběh oddlužení a jsou vymezeny účetní, daňové a právní povinnosti dlužníků v oddlužení. Následně jsou formulována doporučení pro dlužníky v oddlužení, a to se zaměřením na fyzické osoby – podnikatele. Pro účely této práce byly vybrány tři modelové příklady, které vycházejí z reálně existujících insolvenčních řízení skutečných fyzických osob, na nichž je ukázán průběh insolvenčního řízení, (ne)plnění oddlužení a porušování povinností dlužníků v oddlužení.

Abstract:

This thesis is focused on solving a bankruptcy of self-employed natural persons through debt relief in the combined form of fulfillment of the repayment schedule with monetization of the assets. Based on literature research and description, the typical process of debt relief is described and the accounting, tax and legal obligations of debtors in debt relief are defined. Then, recommendations for debtors in debt relief, focused on self-employed persons, are formed. For the purposes of this thesis, three examples based on real insolvency proceedings of real natural persons were chosen. These examples show the process of insolvency proceedings, the (non)fulfilment of debt relief and the violation of obligations of debtors in debt relief.
