Working Time and Periods of the Rest in the Czech Labour Law

Abstract:

Diplomová práce se věnuje tématu pracovní doby a dob odpočinku v českém pracovním právu. Je rozdělena do dvou částí, z nichž první je věnována pracovní době a druhá dobám odpočinku. V rámci pracovní doby je rozebrána problematika její délky, rozvržení, práce přesčas, noční práce, pracovní pohotovosti, evidence pracovní doby a konta pracovní doby. V rámci dob odpočinku je rozebrána problematika přestávek v práci, nepřetržitého odpočinku mezi dvěma směnami, nepřetržitého odpočinku v týdnu, dnů pracovního klidu a dovolené. Práce vychází z nejnovějších výsledků pracovněprávní teorie, ze současné české a unijní právní úpravy a také z aktuální judikatury.

Abstract:

This thesis is focused on Working Time and Periods of the Rest in Czech Labour law. The thesis is divided into two parts, the first of which is devoted to Working Time and the second to Periods of the Rest. The first part mainly aims on length of working time, organization of working hours, overtime work, night work, state of alert for work, records of working hours and account of working hours. The second part mainly looks at work breaks, continuous rest between shift, continuous weekly rest and holiday. The thesis is based on the latest results of the labour theory, contemporary Czech and EU legislation and the current case-law.
