Abstract:

S očekávanými změnami podmínek vyplývajících z procesu globalizace, kdy dochází ke změně norem, postupů a metodik je nezbytné přehledně mapovat a znát celkový význam technických a právních norem. Diplomová práce poukazuje na tyto klady i záporné jevy vývoje technických a právních norem a řešení výše skutečné škody při pojištění odpovědnosti vozidel. Analyzuje vlastní proces vyhotovení znalecké práce v jednotlivých krocích od požadavku a zadání vzneseného pojistitelem až na vlastní odbornost znalce a jeho profesní autoritu. Konkrétně se zabývá listinnými důkazy a podporou znalecké práce v řešení pojistné události. Hlavní zaměření je problematika určení skutečné škody vzniklé na vozidle. Diplomová práce dále mapuje hodnověrnost metodik a postupů vycházejících z praxí ověřených technických a právních norem cestou vybalancování mezi praktickou zkušeností při řešení konkrétních pojistných událostí a zpracování znaleckých posudků a mezi praxí a teorií, teoretickými východisky, které vychází z teoretických východisek. Diplomová práce se dále zabývá specifickými trendy v oborech znalectví a likvidace pojistných událostí kam zejména patří aplikace SW a využití digitalizačních procesů, spolupráce se smluvními partnery ve vztahu k řešení procesů likvidace pojistných událostí a elektronické komunikace. V této práci je uváděna komparace pojistné události, kterou se podařilo zpracovat do jednotlivého schéma, až po vyhotovení praktického příkladu výpočtů skutečné škody soudního experta-znalce.

Abstract:

With the coming changes of conditions related to the globalisation process, where there are changes in the norms, proceedures and mothodologies, i tis unnecessary to monitor and know the overall importance of technical and legal norms. The dissertation draws attention to the advantages and disadvantages of the development of technical and legal norms and solution to the level of actual damage from insurance for the car insurance. It analyzes the actual process of elaboration of the expertise report in individual steps from the requirement and claim of the insurer to the proficiency of the expert and his professional authority. Specifically it deals with primary evidence and support of the expertise in solving the insurance event. It mainly deals with the determination of the actual damage to the vehicle. The dissertation also deals with credibility of methodology and procedures based on experience with verified technical and legal norms through balance of experience from dealing with specific insurance events and elaboration of reports and balance of practice and theory, theoretical solvent, which is based on theoretical solvents. The dissertation is also dealing with specific trends in the expertise area and liquidation of insurance events such as application of SW and usage of digitalizing procedures, cooperation between contracted partners in relation to the solution to liquidation process of insurance claims and electronic communication. In this dissertation there is a comparison of insurance event, which was managed to be elaborated into individual scheme including elaboration of practical example of calculations of actual damage by expert appointed by court.
