The Concept of Responsibility to Protect from the Perspective of the United Nations' Response to the Conflict in Southern Kyrgyzstan in June 2010

Abstract:

Odpovědnost za ochranu (Responsibility to Protect, R2P), koncept snažící se o usmíření dvou zcela odlišných mezinárodně-právních principů, jakými jsou suverenita a lidská práva, byla na plenárním zasedání Valného shromáždění Organizace spojených národů přijata v roce 2005, čtyři roky po svém vzniku. Zda se jednalo o přijetí pouze formální či zda je koncept reálně aplikován, je otázkou, kterou práce zodpovídá na základě analýzy konkrétního případu, jímž je reakce OSN na konflikt v jižním Kyrgyzstánu v červnu 2010. Po potvrzení předpokladu o aplikovatelnosti R2P na základě zpráv několika vyšetřovacích komisí a po zjištění, že se OSN v rámci své reakce konceptem neřídila, je identifikováno několik faktorů, které tento nesoulad mezi deklarovanou odpovědností jednat a reálnou nečinností mohly způsobit. Mezi faktory politickými je jmenována především nedostatečná motivace klíčových členů Rady bezpečnosti OSN schválit za nepřehledné situace a v rámci konfliktu přímo neohrožujícím jejich ekonomické či politické zájmy jakoukoliv akci a mezi faktory normativními neexistence spolehlivého mechanismu včasného varování a procedury řešící politické zablokování Rady bezpečnosti OSN.

Abstract:

Responsibility to Protect (R2P), a concept attempting to reconcile two very different international-law principles of sovereignty and human rights, was adopted by the plenary session of the United Nations General Assembly in 2005, four years after its creation. Whether the adoption was just formal or whether the concept is really being applied, is a question which the work answers on the basis of a concrete case analysis. The chosen case is the reaction of the UN to the conflict in the southern Kyrgyzstan in June 2010. Having confirmed the assumption concerning the applicability of R2P on the basis of investigating commissions' reports and having found out that the UN did not follow the concept when reacting to the conflict, several factors that could have caused the discrepancy between declared responsibility and real inaction are identified. Insufficient motivation of the key members of the UN Security Council to approve any action in a confusing situation and in a conflict which was not directly threatening their economic or political interests is named among the political factors and the absence of a reliable early-warning mechanism and of a procedure addressing the political block in the UN Security Council are named among the normative ones.
