The Doctrine of Just War in Contemporary View

Abstract:

Teorie spravedlivé války je základním hodnotícím měřítkem pro určení spravedlnosti či nespravedlnosti válečného konfliktu. Tuto teorii můžeme vnímat jako kompromis mezi pacifismem, pro který je válka vždy zlem, které nelze legitimizovat, a realismem, který je převážně řízen touhou po moci. Podléhá určitým kritériím, kritériu vstoupení do války, jus ad bellum, a kritériu spojenému se samotným vedením války, jus in bello. Práce přiblíží tato kritéria, jejich nejednoznačnost a lehkou napadnutelnost a jednotlivé principy vedení spravedlivé války, které k nim náleží. Dalším důležitým bodem této práce jsou významné otázky současné diskuze, například morální rovnost vojáků spravedlivě i nespravedlivě bojující strany. Došla jsem k závěru, že morální rovnost je nutným prvkem spravedlivé války, vojáci bojují za svou vlast mnohdy v přesvědčení, že právě oni bojují za spravedlivé ideály. Není důležité, na jaké straně bojují, ale jaký způsob boje volí, zdali dodržují imunitu civilistů, lidská práva a nepáchají válečné zločiny. To závisí se vztahem jus ad bellum s jus in bello. Závěr práce poukazuje na relativně novou hrozbu terorismu, nestátních ozbrojených aktérů a komplikovanost obrany proti tomuto fenoménu.

Abstract:

The Theory of Just War is the main aspect for measuring of justification of war. We can see this theory as a compromise between pacifism, for that is war always an evil, and realism, which is rulled by a desire for a power. The Tehory of Just War is consist of two criterions. The first one is criterion which is connected with entering the war Jus ad bellum, and the second one is connected with everything what happend during the war Jus in bello. This work will have describe these criterions and shows their ambiguity and that their principles are very unsafe. The next part of this work is question of current discussion, for example the moral equality of soldiers. The conclusion is that the moral equality of soldiers is necessary element of Just War Theory becouse of good intention of combatant. It is not important which side do they fight, but what kind of fighting do they use. If they respect the imunity of bystanders and human rights. That is connected with the relation of jus ad bellum and jus in bello. The end of this work is describing relatively new threat of terorism, non-state actors and complicated way of defence against this phenomenon.
