Litigations Between Subjects and Landlords in Moravia in the Early 18 th Century

Abstract:

Spory poddaných v vrchnostmi na Moravě počátkem 18. století Studie představuje sondu do sporů poddaných s vrchnostmi na Moravě z let 1700-1715 s důrazem na období počátku vlády Josefa I., kdy došlo k masovému petičnímu hnutí. Analyzuje samotný průběh těchto pří a pokouší se i vysvětlení jejich příčin. Důraz pokládá na změny právního postavení poddaných před nově zřizovanými vyšetřovacími komisemi tribunálu (vrcholného zeměpanského úřadu na Moravě). Jejich rovnější postavení vůči vrchnostem v těchto soudních sporech výrazně přispělo k získání alespoň částečného pocitu právní jistoty a tím k celkové emancipaci venkovského obyvatelstva.

Abstract:

Litigations Between Subjects and Landlords in Moravia in the Early 18th Century The study constitutes an exploration into the litigations between subjects and landlords in Moravia between 1700-1715. The emphasis is laid on the period of early reign of Emperor Joseph I, which saw the rise of a mass petition movement. The study is an analysis of these litigations and it offers explanations of their possible causes. Stress is also put on the changes of legal position of subjects prior to newly constituted investigation boards of the tribunal (highest manorial office in Moravia). More equal standing of the subjects in these litigations contributed to their feeling of at least some degree of legal assurance and therefore to emancipation of the rural population.
