Abstract:

Tato diplomová práce popisuje vývoj krajského zřízení s akcentem na jeho orgány, a to od doby pobělohorské, až po současnou právní úpravu. První část práce se věnuje organizaci krajské správy v době pobělohorské v letech 1620 – 1848, na jejímž konci dochází k přebudování zastaralého feudálního aparátu na nový, modernější systém po vzoru Pruska. Dále se tato práce zabývá krajskou správou v období Habsburské monarchie, kdy již byly vytvořeny zákonné předpoklady pro vznik krajské samosprávy. Poměrně obsáhle se tato práce věnuje organizaci krajského zřízení v socialistickém Československu v letech 1948 – 1990. Tuto část diplomové práce autor považuje za důležitou z hlediska srovnání fungování krajské samosprávy v období nesvobody s fungováním současné krajské samosprávy. Následně je samostatně popsaná formou krátkého exkurzu příprava reformy veřejné správy v 90. letech minulého století. Stěžejní částí práce je detailní rozbor právní úpravy jednotlivých orgánů kraje, především zastupitelstva kraje. Další část práce se zabývá reformou veřejné správy na Slovensku a v Polsku a organizací samosprávy v obou státech. V závěru autor srovnává orgány krajské samosprávy v ČR, Polsku a na Slovensku a formuluje své připomínky a návrhy k právní úpravě krajského zřízení z pohledu de lege ferenda.

Abstract:

This diploma paper describes the evolution of regional system with emphasis on the regional bodies in the period from 1620 till current legal regulation. The first part of my diploma paper is concerned with the organization of regional administration in the period from 1620 to 1848. In the end of this period, the old feudal apparatus is replaced by new modern system, similar to the Prussian system. The work is also describing regional administration in the period of Hapsburg monarchy, when legal preconditions for the creation of new regional municipal authorities were created. Quite extensive is the part of this work, which is about organization of regional system in socialistic Czechoslovakia in years 1948 – 1990. I consider this part of my diploma paper important with the view of comparison of function of regional municipal authorities in the time of submission and the current regional municipal authorities. Consequently I separately describe in the form of short discursion the preparation of public service reform in the 90´s. The main part of my work contains the close description of legal regulation of regional bodies, especially the regional board. The next part is about the reform of public service in Slovakia and Poland and about the organization of self – government in both states. In the end, I compare regional bodies in the Czech Republic, Poland and Slovakia and I form my remarks and suggestions for the future legal regulation of our regional system.
