Power torts in municipal and urban law

Abstract:

Cílem práce je podat přehled o mocenských deliktech v zemském a městském právu. Práce je postavena na zkoumání trestního práva zejména v období stavovské monarchie, neboť toto období je jakýmsi průřezem nejrůznějších vývojových vrstev práva a odhaluje vývoj feudálního trestního práva vůbec. V průběhu zkoumání je rovněž proveden pokus o komparaci mocenských deliktů v obou oblastech, právu zemském a městském. Co se týče obsahu práce, je rozdělena do dvou základních částí. Obecná část je zaměřena na obecný výklad, který se týká samotného stavovského období a stavovského práva. Ve stručnosti je představeno zemské a městské právo. Uvedeny jsou i formy a prameny práva a významné kodifikace stavovského období, ze kterých práce vychází. Před samotným rozborem mocenských deliktů je věnována pozornost také klasickému trestnímu právu, tedy trestnímu právu v období stavovské monarchie. Obecná část je zakončena popisem procesu a trestů, které byly v tomto období ukládány. Zvláštní část práce je zaměřena již na samotnou problematiku mocenských deliktů. Nejprve jsou vytyčeny základní oblasti, ve kterých je možné tyto delikty naleznout. Poté je proveden juristický rozbor jednotlivých ustanovení. Jsou vymezeny skutkové podstaty těchto deliktů a pozornost je věnována i vývoji a historickým kořenům. V průběhu jsou uváděny i historické příklady, ve kterých byly mocenské delikty zachyceny. V závěru práce jsou uvedeny hlavní výsledky zkoumání.

Abstract:

The aim of this thesis is to give an overview of power torts in municipal law, as well as urban law. The thesis is based on the investigation of criminal law especially in the period of the Estates monarchy, because this period represents a cross-section of various developmental layers of law and reveals the development of feudal criminal law in general. In the course of the investigation, an attempt is also made to compare power torts regarding both the municipal law and urban law. As for the content of the work, it is divided into two basic parts. The general part is focused on general interpretation, concerning the period of the estates of the realm and its law. In brief, the municipal law and urban law are introduced. The forms and sources of law, as well as significant codification of the estate period, on which the work is based, are also presented. Prior to the power torts analysis, attention is also paid to classical criminal law, i.e. criminal law in the period of the Estates monarchy. The general part ends with a description of the process and punishments that were imposed during that period. A special part of the thesis is focused on the issue of power torts. First, the basic areas in which these torts can be found are outlined. A juristic analysis of the individual provisions is then made. The facts of these torts are defined and attention is paid to the development and historical roots. Historical examples of power torts are also presented. In conclusion, the main results of the research are presented.
