Abstract:

Tato bakalářská práce se věnuje vývoji přestupkového práva v ČR po roce 2017. Pro bližší pochopení kontinuity celé problematiky nejprve předkládá stručný přehled jeho historického vývoje na našem území od konce třicetileté války až do současnosti. Následně se zabývá teoretickým vymezením pojmu přestupek, jeho znaky a typy a hlavními zásadami přestupkového práva. V další části je předmětem práce rozbor nové právní úpravy odpovědnosti za přestupek po roce 2017, tj. především zákona č. 250/2016 Sb., zákon o odpovědnosti za přestupky a řízení o nich. Rozbor zahrnuje jak stránku hmotněprávní – vymezení pojmů, působnost zákona, základy odpovědnosti za přestupek, správní tresty a podmínky jejich ukládání, tak i procesněprávní – řízení o přestupcích a průběh přestupkového řízení. Prostor je věnován též zákonu č. 251/2016 Sb., zákon o některých přestupcích a pozdějším zákonům navazujícím na zákon. č. 250/2016 Sb. Práce analyzuje hlavní změny v oblasti přestupkového řízení po roce 2017 jak v rovině teoretické, tak i z hlediska jejich praktických dopadů na vývoj přestupků po roce 2017. Ve svém závěru práce posuzuje přínosy a negativa nové právní úpravy přestupkového práva po roce 2017 a provádí jejich konečné vyhodnocení.

Abstract:

This bachelor's thesis is devoted to the development of misdemeanor law in the Czech Republic after 2017. For a closer understanding of the continuity of the entire issue, it first presents a brief overview of its historical development in our territory from the end of the Thirty Years' War to the present day. Subsequently, it deals with the theoretical definition of the concept of misdemeanor, its signs and types, and the main principles of misdemeanor law. In the next part, the subject of the thesis is the analysis of the new legislation on liability for misdemeanors after 2017, i. e. primarily Act No. 250/2016 Coll., the Act on Liability for Misdemeanors and Proceedings About Them. The analysis includes both the substantive side – definition of concepts, the scope of the law, the basis of liability for a misdemeanor, administrative penalties and the conditions of their imposition, as well as the procedural side – misdemeanor proceedings and the course of misdemeanor proceedings. Space is also devoted to Act No. 251/2016 Coll., the Act on Certain Offenses and later laws following the Act. No. 250/2016 Coll. The work analyses the main changes in the matter of misdemeanor proceedings after 2017, both theoretically and in terms of their practical impact on the development of misdemeanors after 2017. In its conclusion, the work assesses the benefits and negatives of the new legislation of misdemeanor law after 2017 and performs their final evaluation.
