The Referendum as an Instrument of Direct Democracy in the Czech Republic

Abstract:

Diplomová práce se zabývá referendem, jakožto nástrojem přímé demokracie v České republice, které je nejčastěji používanou možností přímé participace na správě věcí veřejných. Obsahuje pohledy vybraných autorů na přímou demokracii, které slouží jako teoretické východisko. Diplomová práce rovněž řeší obecně přímou demokracii a její jednotlivé nástroje a poukazuje na její klady a zápory. Konkrétněji se práce věnuje historii a situaci přímé demokracie v České republice. Následující část pohlíží na problematiku celostátního referenda a jeho zakotvení v právním řádu ČR. Cílem této práce je odhalit možné důvody, proč nebylo přijato celorepublikové referendum. Vyústěním práce je hodnocení kladů a záporů referenda.

Abstract:

This thesis deals with the referendum as an instrument of direct democracy in the Czech Republic, which is the most used option of direct participation. This thesis contains views of selected authors on direct democracy, which serves as the theoretical basis. The thesis deals in general with direct democracy, its individual tools and its pros and cons. This thesis focuses on the history and situation of direct democracy in the Czech Republic. The following section looks at the issue of a national referendum and placing in the legal order of the Czech Republic. The central point of the whole thesis lies in the identification of possible reasons, why it was not accepted national referendum. The thesis results in evaluation of the pros and cons of the referendum.
