Abstract:

Předmětem dědění je majetek, který tvoří soupis aktiv a pasiv (dluhů) zanechaný zůstavitelem. Dědic vstupuje do právního postavení svého předchůdce, což je podstata dědění.Dědictví se nabývá okamžikem smrti zůstavitele, přesto je však nutné, aby došlo k vydání konečného rozhodnutí v řízení o dědictví, kterým je potvrzeno nabytí dědictví. Toto rozhodnutí má pouze deklaratorní povahu s účinky nastávají ex tunc. Dědění je možné jak ze závěti, tak ze zákona, ale je možné i z obou těchto důvodů. Přednost má dědic ze závěti, nebyl-li jeho ustanovením zkrácen na svých právech zkrácen potomek zůstavitele. Přesto, že má každý právo svobodně se rozhodnout o tom, jak naloží se svým majetkem pro případ smrti. Zákon zaručuje ochranu úzkému okruhu osob, tzv. ?neopomenutelným dědicům?. Potomkům se tedy musí dostat, pokud nebyli z vážných důvodů tohoto práva zbaveni, alespoň povinný podíl. Vydědit lze pouze potomka zůstavitele a jen z důvodu taxativně vyjmenovaných v zákoně. Není-li závětního dědice, nebo pokud není způsobilý dědit, či dědictví odmítne, nastupují na jeho pozici dědic ze zákona. Tito dědicové jsou rozdělení podle stupně příbuznosti do čtyř dědických skupin. Ve své práci jsem se věnovala v  jakém rozsahu a kdy jsou povoláni tito dědicové jako právní nástupci do práv a povinností zůstavitele. Rovněž zde je pojednáno, co se stane s majetkem, není-li závětních ani zákonných dědiců, popř. když tito dědictví odmítnou.

Abstract:

The subject matter of the inheritance is the property, which constitutes a list of assets and liabilities (debt) left behind by the deceased. The heir takes up the legal position of his antecedent, which is the essence of the inheritance.The inheritance is acquired at the moment of death of the deceased. However, it is necessary to have the final decision on inheritance proceedings issued, which confirms acquisition of the inheritance. This decision has only a declarative nature, being effective ex tunc. To inherit is possible under the will as well as the law but it is possible to inherit according both of these reasons. The priority is given to the heir under the will unless his appointment reduced the rights of a descendant of the deceased; although everyone has his right to decide freely on how he shall deal with his property in case of death. The law guarantees protection to a close circle of persons ? the ?forced heirs.? Therefore, descendants must receive at least their obligatory share unless they were deprived of this right due to serious reasons. It is possible to disinherit only a descendant of the deceased and only due to the reason enumaratively listed in the law. If there is no testamentary heir or if he is unfit to inherit or if he refuses the inheritance, his position is taken by an heir under the law. These heirs are divided into four inheritance groups according to the level of kinship. This thesis concentrates on when and to which extent these heirs are called up as legal successors for the rights and duties of the deceased. It also states what shall happen to the property if there are no testamentary or legal heirs or if these heirs refuse the inheritance.
