Issues related to the application of the principle of the best interests of the child

Abstract:

Tato bakalářská práce zkoumá aplikaci kritérií principu nejlepšího zájmu dítěte v kontextu rozhodování o porozvodové péči v praxi OSPOD ve městě Teplice. Zaměřuje se specificky na konflikt mezi právem na zachování rodinného prostředí a udržování vztahů a právem na péči, ochranu a bezpečí dítěte. Cílem práce bylo porovnat teoretická východiska s praxí sociálních pracovnic z OSPOD Teplice. Výzkum se soustředil na specifikace aplikování konceptu nejlepšího zájmu dítěte ve vyhrocených rodičovských sporech, přičemž ukázal, že sociální pracovnice z OSPOD Teplice tyto teoretické základy ve své praxi náležitě aplikují v rámci svých kompetencí a pravomocí. Také zdůraznil, s jakými dilematy se sociální pracovnice v posuzování nejlepšího zájmu dítěte potýkají.

Abstract:

This bachelor thesis examines the application of the criteria of the principle of the best interest of the child in the context of decision-making on post-divorce care in the practice of the OSPOD in the city of Teplice. It focuses specifically on the conflict between the right to preserve the family environment and maintain relationships and the right to care, protection and safety of the child. The aim of the thesis was to compare the theoretical background with the practice of social workers from OSPOD Teplice. The research focused on the specification of the application of the concept of the child's best interests in escalated parental disputes, showing that social workers from OSPOD Teplice apply these theoretical foundations in their practice within their competences and authorities. It also highlighted the difficulties that social workers face in assessing the child's best interests.
