Moment of the Beginning of the Criminal Prosecution and its Impacts on the Criminal Proceedings

Abstract:

Cílem bakalářské práce je provést rozbor okamžiku zahájení trestního stíhání a jeho důsledků pro trestní řízení. Obsahem práce je mimo jiné sdělení důvodů, pro které bylo trestní stíhání zahájeno a jeho nepřípustnost, rozbor usnesení o zahájení trestního stíhání, jeho náležitostí, jakož i následky a účinky tohoto usnesení. Práce obsahuje zmínku o stížnosti, tedy možnosti, jak se proti usnesení o zahájení trestního stíhání bránit. V krátkosti je zmiňováno i zkrácené přípravné řízení, některé druhy zvláštních způsobů řízení a práva a povinnosti obviněného a stejně tak zajištění nároku poškozeného. V závěru bakalářské práce je uveden krátký průzkum. Práce má popisný charakter.

Abstract:

The aim of the thesis is to analyze the commencement of the prosecution and its consequences for DU-criminal proceedings. This work contains among others apprised of the reasons for which the prosecution was instituted and its inadmissibility, analysis resolution to initiate criminal proceedings, its requirements, and the consequences and effects of this resolution. Work includes mention of the complaint, ie ways against a decision to initiate criminal prosecution to defend. In short, it is mentioned even summarily, certain specific types of management methods and the rights and obligations of the accused, as well as securing the claim of the victim. Ac-indeed, the thesis is a brief survey. Work is descriptive.
