Abstract:

Diplomová práce se zabývá postavením a rolí zákonodárných sborů, a to nejen v České republice, ale i ve vybraných státech EU a USA. V úvodní části je kladen důraz na zákonodárné sbory z pohledu státovědy. To znamená, že na zákonodárné sbory pohlíženo prostřednictvím společných znaků, funkcí, struktury, vnitřní organizace a postavení členů. V další části pak práce podává bližší pohled na český zákonodárný sbor. Popisuje jeho historický vývoj a přibližuje činnost a funkce obou komor Parlamentu České republiky, Poslanecké sněmovny a Senátu. Práce poukazuje na běžné zákonodárné procedury, ale i na zvláštní a specifické legislativní postupy. V diplomové práci je pak zvlášť pamatováno na kontrolní a kreační pravomoci. Dále práce ukazuje na vztahy mezi jednotlivými komorami Parlamentu. Další část je věnována vybraným státům, jako je Francie, USA a Španělsko. Tady se pohled upíná k historickému vývoji jednotlivých států a je zde přibližována jejich zákonodárná činnost a jejich pravomoci. Po této části následují komparace zákonodárných sborů České republiky a vybraných států, a to nejen z hlediska jejich postavení, role a zákonodárného procesu, ale hlavně z pohledu jejích kontrolních a kreačních pravomocí. Závěr práce pak obhajuje účel a výhody druhých komor v dvoukomorovém zákonodárném sboru.

Abstract:

The dissertation deals with the position and role of legislature, and this not only in Czech Republic, but also in selected stated of EU and USA. In the initial part the accent is given on legislative body from the view of politics. It means, that the legislative body will be regarded through common signs, functions, structure, inner organisation and members position. In further part the dissertation gives nearer view of Czech legislative body. It describes its historical development and approximates activity and functions of both chambers of Parliament of Czech Republic, Chamber of Deputies and Senate. The work adverts to current legislative procedures, but also to special and specific legislative procedures. In the dissertation there is also remembered the control and creation conmpetence. Further the works shows the relations between individual chambers of Parliament. In further part the attention is paid to selected states, as France, USA and Spain. There the attention is set to historical development of individual states and and there is described their legislative activity and their competences. After this part there follow comparisons of legislative bodies in Czech Republic and selected states, and this not only from the point of view of their position, role and legislative procedure, but mainly from the point of their control and creation competences. The closure of the works then defends the purpose and advantages of second chambers in two chambers legislative body.
