Entry Procedure in Competence of Cadastral Office

Abstract:

Navrhovaná práce popisuje a analyzuje správní řízení v oblasti katastru nemovitostí a to řízení o vkladu do katastru nemovitostí. Vklad do katastru je jedním z nejčastějších druhů zápisu věcných práv do katastru nemovitostí. Práce uvádí hlavní zásady právní úpravy tohoto správního řízení a zákony, které jsou ve vztahu k řízení o vkladu. Mezi typy zápisu do katastru nemovitostí má vklad výsadní postavení a dopad, protože způsobí vznik, změnu nebo zánik vlastnického práva k nemovitosti. Má konstitutivní účinek. Nabytí vlastnického práva může nastat pouze pravomocným rozhodnutím katastrálního úřadu na základě zvláštního postupu pro povolení vkladu. Vzhledem k nedávné změně právních předpisů pro řízení o návrhu vkladu do katastru nemovitostí je hlavním cílem mé práce je vytvořit popis a shrnutí novinek, které přinesla změna legislativy do současného postupu vkladových řízení a nabídnout ucelený obraz o této problematice

Abstract:

The proposed work describes and analyzes the administrative procedures of the cadastre in the field of real estate management and investment . Deposit in the Land Institute is one of the most common types of property rights registration in the Land Register. The paper presents the main principles of this legislation, administrative procedures and laws that exist in relation to the management of the deposit.The deposit has a privileged status amongst other types of land registration, because they impact on and cause the creation, modification or termination of ownership rights to the property. It has constitutive effect. Acquisition of property rights can only occur by a final decision of the land registration office under a special procedure to permit the deposit. The main goal of my work is to create a description and summary of the innovations brought about by the recent change in legislation for the application procedure in the real estate investment and to the procedure of deposit management and to offer a complete picture of the issue
