Tato práce popisuje jednotlivá práva a povinnosti stanovené zákonem mezi zaměstnavatelem a zaměstnancem při závislé činnosti a při tzv. švarcsystému, kdy vykonává pracovník pro zaměstnavatele na živnostenský list práci, která má znaky závislé činnosti.
