Anotácia:

Tato bakalářská práce se zabývá problematikou řešení obchodních sporů prostřednictvím státního soudního řízení a rozhodčího řízení. Cílem této práce je zjistit reálnou efektivitu obou systémů z pohledu podnikatelské praxe a poukázat na hlavní příčiny omezeného využívání arbitráže. Práce je rozdělena na teoretickou část, která vymezuje základní pojmy a specifika obou procesních institutů, a praktickou část zaměřenou na vyhodnocení výsledků provedeného dotazníkového průzkumu a analýzu institucionálních statistik. Na základě získaných poznatků jsou navržena doporučení pro efektivnější řešení konfliktů a širší využití rozhodčího řízení v České republice.

Abstract:

This bachelor thesis deals with the issue of commercial dispute resolution through state court proceedings and arbitration. The aim of this thesis is to determine the real efficiency of both systems from the perspective of business practice and to point out the main causes of the limited use of arbitration. The thesis is divided into a theoretical part, which defines the basic concepts and specifics of both procedural institutions, and a practical part focused on evaluating the results of the conducted questionnaire survey and the analysis of institutional statistics. Based on the acquired knowledge, recommendations are proposed for more efficient conflict resolution and wider use of arbitration in the Czech Republic.
