Abstract:

Bakalářská práce se zabývá otázkou místní příslušnosti soudních exekutorů. Úvodní část práce představuje systém vymáhání pohledávek v České republice, postavení soudního exekutora a dohled nad jeho činností. Hlavním cílem práce je zhodnotit dosavadní pokusy o zavedení místní příslušnosti, uvést její klady a zápory a popsat vybrané modelů teritoriality, které by připadaly v úvahu při jejím zavedením. Práce zahrnuje i srovnání České republiky s vybranými státy Evropy. Závěrečná část práce obsahuje názory subjektů, kteří při své práci přijdou do kontaktu se soudními exekutory.

Abstract:

This bachelor thesis deals with the question of the local jurisdiction of the court executors. The introductory part of the thesis focuses on a system of debt recovery in the Czech Republic, the status of a court executor and the supervision of its activities. The main aim of the thesis is to evaluate the attempts to establish local jurisdiction, to highlight its pros and cons and to describe the selected territorial models that would be considered when i tis introduced. This thesis also includes a comparison of the Czech Republic with selected European countries. The final part of the thesis contains the opinions of the subjects who come into contact with the court executors in their work.
