The Forced Sale of the Company

Abstract:

Bakalářskou práci na téma výkon rozhodnutí postižením závodu mně umožnila psát Vysoká škola Bankovní institut Praha, kde také studuji denní bakalářské studium s názvem Právní administrativa v podnikatelské sféře. Moje bakalářská práce je zaměřena na výkon rozhodnutí postižením závodu. Práce jednak obohacuje zákony o komentáře, ale zároveň jsou zde citovány i paragrafy občanského soudního řádu (dále jen „OSŘ“), které se změnily z důvodu vydání nového občanského zákoníku, a to k 1. 1. 2014. Cílem mé bakalářské práce bylo rozebrat § 338f - § 338zr OSŘ a přidat k nim obohacující komentáře a také ukázat některé změněné paragrafy. Jedním z hlavních pojmů uvedených v mé bakalářské práci je samozřejmě výkon rozhodnutí postižením závodu, který je kodifikován v sedmé hlavě občanského soudního řádu. S hlavním pojmem také souvisí návrh o usnesení výkonu rozhodnutí postižením závodu, správce závodu, cena závodu, dále je dražba závodu a dílčím cílem výkonu rozhodnutí postižením závodu je rozvrh rozdělované podstaty, z něhož se uspokojují pohledávky věřitelů. Výsledek mé bakalářské práce je ten, že jsem obohatil paragrafy o své komentáře, které jsem nastudoval z odborné literatury. Abstract:

My bachelor's thesis the forced sale of the company has allowed me to write college Banking Institute in Prague , where I study daily undergraduate study titled Legal Administration in business. My thesis is focused on enforcement the forced sale of the company. My work on the one hand enriches the laws of comments , but there are also cited sections that have changed due to the drafting of the new Civil Code, which became 1. 1. 2014. Objective of my thesis was to dismantle § 338f – § 338zr OSŘ and add to these comments rewarding and also show some altered sections. One of the main concepts referred in my work is of course the notion of the forced sale of the company, which is codified in the seventh head of Civil code of law. The main concept is also related to a draft resolution to the forced sale of the company, the company manager, factory price below the auction works and target of the forced sale of the company schedule is inherently distributed, which satisfy the claims of creditors. The result of my work is that I enriched sections of your comments, which are from the literature. Some paragraphs I quoted as an example to make it clear where changes have occurred , or paragraphs I quoted that 1. 1. 2014 Rules of Civil Procedure were not.
