Financing of the Extraordinary Chambers in the Courts of Cambodia

Abstract:

Tato bakalářská práce zkoumá financování hybridního tribunálu v Kambodži, který od roku 2006 stíhá nejvyšší představitele totalitní vlády Rudých Khmerů ze 70. let 20. století. Po stručném úvodu do oblasti tranzitivní spravedlnosti jsou ve druhé kapitole představena specifika financování této instituce pomocí analýzy zakládajících dokumentů, rozpočtů a dalších finančních dokumentů. Ve třetí kapitole jsou následně srovnány základní rysy systému financování kambodžského tribunálu se soudy pro Sierru Leone a Libanon. Autor dochází ke zjištění, že kombinace národních a mezinárodních zdrojů sice přispěla ke snížení nákladnosti oproti mezinárodním tribunálům ICTY a ICTR, nedokázala však zabránit významným problémům s nedostatkem financí. Největší část prostředků je poskytována suverénními státy, minoritně přispívají i soukromé subjekty. Administrativa tribunálu činí přes polovinu celkových nákladů, nemalá část je přitom věnována rovněž zajištění obhajoby pro obviněné osoby. Obviněných jedinců je velmi málo, práce tak může být podkladem pro další zkoumání významu těchto tribunálů v kontextu jejich nákladů.

Abstract:

This bachelor's thesis explores the financing of the hybrid tribunal in Cambodia, which has been prosecuting the highest leaders of the Khmer Rouge government since 2006. After a brief introduction to the field of transitional justice, the second chapter presents the specifics of this institution’s financial system through the analysis of establishing documents, budgets and other financial documents. The third chapter then compares the basic features of the Cambodian tribunal's financing system with the courts for Sierra Leone and Lebanon. The author finds that while the combination of national and international resources has contributed to reduced costs compared to the ICTY and ICTR, it has not been able to prevent problems with lack of funding. The largest part of funds is provided by sovereign states, with a minority also contributed by private entities. The administration of the tribunal accounts for over half of the total costs, while a significant part is also devoted to ensuring the defence of the accused persons. There are very few accused individuals, so this work can be a basis for further research into the importance of these tribunals in the context of their costs.
