Decisions of the Court of Justice of the European Union - Types, Nature and Effects

Abstract:

Tato diplomová práce se zabývá rozhodnutími Soudního dvora Evropské Unii v širším smyslu. Autor práce se snaží poskytnout přehledný a ucelený rozbor povahy a účinků všech druhů a forem rozhodnutí Soudního dvora EU (tj. rozsudků, usnesení, posudků a také stanovisek generálních advokátů). V první části práce jsou rozebrána obecná východiska soudních rozhodnutí. Důraz je kladen zejména na teoretický základ, obsah a povahu jednotlivých forem rozhodnutí. Opomenuty nejsou ani situace, kdy se jednotlivé formy využívají. Zvláštní pozornost je pak věnována stanovisku generálního advokáta a jeho vlivu na meritorní rozhodnutí. Dále je zkoumána problematika právních účinků rozhodnutí – právní moci a vykonatelnosti. Kromě toho se práce zaobírá dalšími souvisejícími aspekty rozhodnutí, jako jsou například jazyk, oprava, výklad a identifikace.

Abstract:

This thesis focuses on decisions of the Court of Justice of the European Union in a broad sense. It aims to provide a clear and comprehensive analysis of the nature and effects of all types and forms of the decisions of the CJEU (i.e. judgments, orders, opinions of the Court of Justice and opinions of Advocates General). The first part of the thesis analyses the general background of court decisions. Emphasis is placed especially on the theoretical basis, contents and nature of the individual forms of rulings. Situations in which the individual forms of decisions are used are also considered. Particular account is taken of the opinion of the Advocate General and its impact on the respective decision in rem. The thesis further addresses the issue of legal effects of rulings – their legal force and enforceability. Apart from that, the thesis also deals with other related aspects of decisions, such as their language, rectification, interpretation and identification.
