Legal regulations issued by municipalities as part of the legal order of the Czech Republic and experience with their application in practice

Abstract:

Práce seznamuje čtenáře se základy právního řádu České republiky a následně se detailně zabývá postupem tvorby právních předpisů obce. Vysvětluje pojmy samostatná a přenesená působnost obce a v návaznosti na to i základní dělení právních předpisů vydávaných obcí. Neopomíjí ani kontrolní mechanismy, které mají zajistit zákonnost vytvořených právních předpisů. Práce se nezabývá pouze teorií tvorby právních předpisů, ale na konkrétních příkladech ukazuje možnost aplikace právních předpisů do života obce a dále se zabývá někdy složitou možností vymahatelnosti dodržování obcí vydaných právních předpisů. Cílem této práce je představit obec jako tvůrce podzákonných právních předpisů, poskytnout čtenáři, obyvateli obce, základní informace o rozdílech mezi druhy obcí vydávaných právních předpisů, informaci o případné možnosti obrany proti vydaným předpisům a zvýšit jeho povědomí o existenci těchto předpisů, zasahujících různou měrou do jeho života jako občana obce. Výzkumné otázky, kterými se budu v práci zabývat, zní: Jaké oblasti života v obci jsou nejčastěji právními předpisy obcí upravovány? Přinášejí restriktivní vyhlášky obcí očekávaný efekt v praxi?

Abstract:

The thesis introduces the reader to the basics of the legal order of the Czech Republic and then in detail deals with the creation process of legal regulations of the municipality. It explains the concepts of independent and delegated competence of the municipality and, following that, the basic division of legal regulations issued by municipalities. It doesn't neglect control mechanisms to ensure the legality of the created legal regulations. The thesis does not deal only with the theory of the creation of legal regulations, but on specific examples shows the possibility of the application of legal regulations to the life of the municipality and also deals with sometimes difficult possibility of compliance enforcement with legal regulations issued by municipalities. The aim of the thesis is to present the municipality as a creator of subordinate legal regulations, to provide the reader, resident of the municipality, with basic information on the differences between the types of legal regulations issued by municipalities, information on possible ways of defence against issued regulations and increase his awareness of the existence of these regulations, interfering to varying degrees in his life as a citizen of the municipality. Research questions that I will be dealing with in this thesis are: What areas of life in the municipality are most often regulated by legal regulations of municipalities? Do restrictive municipal ordinances bring the expected effect in practice?
