Abstract:

Cílem práce bylo analyzovat možnost nahrazení tradičních smluv za smart kontrakty se zaměřením na technickou proveditelnost a ekonomickou výhodnost. Pro praktické ověření byla analyzována skupina běžných typů smluv – půjčka, nájem, kupní, darovací a úschova. Následně bylo navrženo a implementováno pět prototypových smart kontraktů v jazyce Solidity na platformě Ethereum. Pomocí simulací jejich nasazení byly změřeny náklady v ETH a porovnány s náklady tradičních právních postupů. Výsledky ukázaly, že jednoznačně definované prvky smluv lze do smart kontraktů převést úspěšně, což vede k dramatickým úsporám nákladů – průměrně přes 90 % levněji než při využití právníka). Na druhé straně, prvky vyžadující lidské posouzení či flexibilitu zůstávají neřešeny. Zjištěno bylo také riziko vysoké volatility kryptoměny Ethereum: cena Etherea kolísala v rozsahu přes 120 %, což silně ovlivňuje reálné náklady. Práce tak konkrétně mapuje přínosy i limity smart kontraktů pro smluvní vztahy. Omezení výzkumu vyplývají z úzkého rozsahu (pouze pět smluvních typů) a testů uskutečněných v simulovaném prostředí. Další výzkum by měl zahrnovat širší škálu smluv, zapojení více odborníků a testování řešení v reálném provozu, včetně využití pokročilejších optimalizací, např. opakované použití smart kontraktů pro snížení nákladů.

Abstract:

The paper’s goal was analysing the possibility of replacing traditional contracts with smart contracts, focusing on technological feasibility and cost-effectiveness. Several common types of contracts - loan, lease agreement, contract of sale, contract of donation, and safekeeping agreement - were analysed for practical verification. Five prototype smart contracts were designed and implemented in the Solidity programming language on the Ethereum platform. Their costs in ETH were found by running simulations of their deployment and compared with the expenses of traditional contracts. The results show that unambiguously defined aspects of contracts can be successfully converted into smart contracts, leading to dramatically reduced expenses - over 90% cheaper on average. On the other hand, elements requiring personal review or flexibility remain unresolved. The risk of high Ethereum volatility was observed as well: the exchange rate of Ethereum fluctuated in the range of over 120%, significantly affecting the true cost. The paper thus examines both the benefits and limits of smart contracts. The limits of this paper are in its narrow scope (only five types of contracts) and the simulated environment for running tests. Further research should focus on a broader range of contract types, include multiple experts and test their solutions in real-life scenarios, as well as the use of more advanced optimization, such as repeated use of a smart contract for cost-efficiency.
