Abstract:

Diplomová práce s názvem „Finanční analytický úřad a jeho úkoly v boji proti legalizaci výnosů z trestné činnosti a financování terorismu“ – se zabývá problematikou legalizace výnosů z trestné činnosti s důrazem na práci Finančního analytického úřadu. Teoretická část práce obsahuje veškeré elementární informace, které jsou nutné k pochopení této problematiky. Popsána je činnost Finančního analytického úřadu, který se tomuto tématu na území České republiky věnuje, dle zákona č. 253/2008 Sb., o některých opatřeních proti legalizaci výnosů z trestné činnosti a financování terorismu. Zvláštní část práce je zaměřena na některá vznikající rizika spojená s fenoménem kryptoměn. Součástí praktické části diplomové práce je úvaha, jaké nebezpečí může vzrůstající popularita těchto decentralizovaných měn představovat v oblasti legalizace výnosů z trestné činnosti s návrhy možných řešeni či opatření. Závěrem je předloženo fiktivní Oznámení podezřelého obchodu ze strany kryptosměnárny s následným popisem zpracování obdrženého podnětu k šetření na půdě Finančního analytické úřadu. V zájmu zkrácení doby šetření a vlastní analýzy těchto specifických podnětů, uvádím nedostatky a chyby, kterých se dopouštějí právě povinné osoby poskytující služby s virtuálními aktivy.

Abstract:

The diploma thesis entitled "Financial Analytical Office and its tasks in the fight against money laundering and financing of terrorism" – deals with the issue of countering money laundering with an emphasis on the work of the Financial Analytical Office. The theoretical part of the diploma thesis contains all the elementary information necessary to understand this topic. The thesis discribes the activities of the Financial Analytical Office, which deals with this issue in the Czech Republic, according to Act No. 253/2008 Coll., on Selected Measures against the Legalization of Proceeds of Crime and Financing Terrorism. A special part of the work focuses on some emerging risks associated with the cryptocurrency phenomenon. Part of the practical part of the thesis is the consideration of the threat that the increasing popularity of these decentralized currencies can pose in the area of fighting money laundering with proposals for possible solutions or measures. Finally, a fictitious Suspicious Transaction reported by a crypto-currency exchange office is provided, followed by a description of processing of the Suspicious Transaction Report by the Financial Analytical Office. In order to reduce the time for investigation and analysis of these specific reports, I list the shortcomings and errors made by obliged entities providing virtual assets services.
