Modification of employee relationship of local government officers

Abstract:

Rigorózní práce je zaměřena na problematiku potenciality modifikace zaměstnaneckého vztahu úředníků územních samosprávných celků dle zákona č. 312/2002 Sb., o úřednících územních samosprávných celků, a to za současné komparace v něm zakotvené regulace s úpravou obsaženou v zákoně č. 234/2014 Sb., o státní službě. Cílem tohoto textu je zhodnotit, zda současná právní úprava zaměstnaneckého vztahu úředníků územních samosprávných celků obsažená v zákoně č. 312/2002 Sb. umožňuje harmonizaci, popř. též unifikaci statusu těchto osob s regulací, jíž podléhají státní zaměstnanci v režimu zákona č. 234/2014 Sb. Za tímto účelem je provedeno srovnání některých izolovaně analyzovaných základních aspektů ovlivňujících charakter pracovního, resp. služebního poměru v režimu dvou výše uvedených právních předpisů. Tato selektivní komparace zohledňuje určitá specifika samosprávy a státní správy, jejichž základní vymezení, včetně jejich vzájemného vztahu, je v této práci taktéž činěno. Následně je provedeno celostní zhodnocení proveditelnosti zakotvení služebního poměru úředníků územních samosprávných celků. Závěrečná část práce je poté věnována autorovým úvahám nad některými konsekvencemi, které by hypotetické přijetí koncepce služebního poměru úředníků územních samosprávných celků mohlo vyvolat.

Abstract:

This thesis is focused on the question whether modification of employee relationship of local government officers according to the Local Government Officers Act (No. 312/2002 of the Legal Code) could be accomplished which is being herein compared to the legislation contained in the Civil Service Act (No. 234/2014 of the Legal Code). The aim of this thesis is to evaluate whether the current legislation related to the employee relationship of local government officers contained in the Local Government Officers Act (No. 312/2002 of the Legal Code) provides any space for harmonisation, possibly unification as well, of these persons´ status with the legislation that civil servants are according to the Civil Service Act (No. 234/2014 of the Legal Code) subject of. Following this purpose, the comparison of selected, separately analysed, basic aspects influencing the characteristics of the employment or civil service employment under two above mentioned Acts is done. This selective comparison takes certain particularities of self-government and public service into account whose basic definition, including their mutual relationship, is also done in this thesis. Subsequently, the general assessment is being done to judge the possibility of local government officers´ civil service employment being enacted. The closing part of the thesis includes author´s contemplation about some of the consequences that the hypothetic enactment of the conception of the local government officers´ civil service employment could cause.
