The Effectiveness of Community Service Sentences.

Abstract:

Tématem diplomové práce je Efektivnost výkonu trestu obecně prospěšných prací (dále jen OPP). Cílem práce je zjistit, zda je efektivní a potřebné zapojení PMS do procesu OPP, a to jak v přípravné, tak v realizační fázi. Práce se zabývá obecným vymezením role Probační a mediační služby na poli trestní politiky s hlubším zaměřením na trest OPP. Dále popisuje jednotlivé úkony probačního pracovníka při přípravě pokladů pro soudce k uložení této formy potrestání a následnou realizaci trestu OPP ve vykonávacím řízení. Diplomová práce podává obraz o tom, v čem spočívá význam přípravy podkladů k ukládání alternativního trestu OPP, jak probíhá realizace a kontrola jeho výkonu a jaký je jeho účel. Diplomová práce je rozdělena na část teoretickou a praktickou.

Abstract:

The topic of this diploma thesis is Effectiveness of the execution of community service. The aim of the thesis is to find out whether the PMS implementation in the Community service process, both in the preparatory phase and in the implementation phase is effective and necesarry. The thesis deals with the general definition of the role of Probation and Mediation Service in the field of criminal policy with a deeper focus on Community service punishment. Furthermore, it describes the individual actions of a probation worker in preparing documents for judges to impose this form of punishment and the subsequent execution of the Community service penalty in enforcement proceedings. The diploma thesis shows what lies the importance of preparing documents for imposing alternative punishment, what is the procedure of the implementation and control of its performance and what is its purpose. The thesis is divided into theoretical and practical part.
